Key Statutory Rules & Public Aviation Law Summary

Why even a 40-minute delay on your first flight can trigger €600 / £520 compensation if you miss a connecting flight and reach your final destination 3+ hours late.

  • In Folkerts (C-11/11), the Court of Justice ruled that what matters under EC 261/2004 is the delay at your final ticketed destination—not the duration of the delay on the first feeder flight.
  • Even if your first flight was delayed by only 45 minutes due to a technical or operational issue, if that caused you to miss your connection on the same booking (PNR) and arrive 3+ hours late at your final destination, full compensation (€250–€600 / £220–£520) generally applies.
  • In Wegener v Royal Air Maroc (C-537/17) and České aerolinie (C-502/18), the Court confirmed that a journey departing an EU airport with a connection outside the EU (e.g., Casablanca, Doha, Dubai, Istanbul, or Addis Ababa) on a single booking is treated as a single whole journey covered by EC 261/2004.
  • Self-transfer tickets booked separately on two different booking references (PNRs) are generally not protected as a single connecting journey unless booked as a single through-contract.
