Key Statutory Rules & Public Aviation Law Summary
Why you should never accept a small airline voucher before checking your statutory Denied Boarding rights (€250–€600 in EU/UK or up to $1,550 USD in the United States).
- Voluntary vs Involuntary Bumping: If an airline asks for volunteers to give up their seats in exchange for travel vouchers, accepting volunteers waive their statutory fixed cash compensation.
- If you are bumped against your will (Involuntary Denied Boarding) after presenting yourself for check-in/boarding on time, Article 4 & Article 7 of EC 261/2004 / UK261 entitle you immediately to €250–€600 / £220–£520 in cash, PLUS rerouting or a full refund and meals/hotel.
- In the United States (14 CFR Part 250), involuntary denied boarding pays up to $775 USD (1–2 hr delay) or up to $1,550 USD (2+ hr delay domestic, 4+ hr international).
- In Cachafeiro v Iberia (C-321/11), the Court of Justice ruled that 'denied boarding' isn't limited to overbooking—it also covers cases where an airline wrongly closes boarding or reallocates your seat assuming you would miss a connection!
