Key Statutory Rules & Public Aviation Law Summary
How UK261 applies to all Virgin Atlantic flights departing or arriving in the UK from the US, Caribbean, South Africa, India, and Asia.
- As a UK-licensed operating air carrier, Virgin Atlantic is covered by UK261 on ALL flights—whether departing London Heathrow/Manchester or flying into the UK from New York, Orlando, Johannesburg, Cape Town, Delhi, or Lagos.
- Because virtually all Virgin Atlantic routes exceed 3,500 km, a qualifying cancellation or arrival delay of 4+ hours entitles each passenger to £520 (or £260 if delayed between 3 and 4 hours).
- Under Section 9 of the UK Limitation Act 1980, passengers in England & Wales have up to 6 years from the flight date to claim UK261 compensation.
